“We” means LendKey Technologies, Inc., its affiliates, subsidiaries and related companies, operating LendKey.com and all associated websites (collectively, this “Website”).

“You” means each individual that uses the www.LendKey.com website.

By using this Website, you agree to this Credit Report Policy, and your use of this Website is subject to all of the terms set forth herein. If you do not agree to this Credit Report Policy, you should not use this Website.

LendKey reserves the right at its sole discretion to modify this Credit Report Policy at any time. Any updates or revisions of this Credit Report Policy will solely be posted on this Website and will be effective immediately upon posting. You will be deemed to have accepted the changes to this Credit Report Policy if you continue to use this Website.

Credit Inquiry and Authorization

A consumer report (“credit report”) may be obtained from a consumer-reporting agency (“credit bureau”) in connection with a loan offered via this Website. If you request (i) you will be informed whether or not consumer reports were obtained, and (ii) if reports were obtained, you will be informed of the names and addresses of the credit bureaus that furnished the reports. If the lender agrees to make this loan to you, a consumer credit report may be requested or used in connection with renewals or extensions of any credit for which you have applied, reviewing your loan, taking collection on your loan, or legitimate purposes associated with your loan.

“Soft” Credit Inquiry

When you visit LendKey.com, you may have the opportunity to review loan options that may be available to you based on your credit report and information that you initially provide on the Website. In order to provide you with these loan options, we may conduct a “soft” credit pull, which you will consent to when you click on “Get My Rate.” This written consent under the Fair Credit Reporting Act authorizes LendKey to obtain information from your personal credit report from the credit bureau, Experian (701 Experian Parkway, P.O. Box 2002, Allen, TX 75013; www.experian.com). This “soft” credit pull will have no effect on your credit score.

“Hard” Credit Inquiry

In the event that you select a loan option displayed to you, you will be required to complete and submit a full loan application, at which point a “hard” credit pull will be conducted. This credit inquiry may be recorded on your credit report and may have an effect on your credit score. Prior to submitting your application, you will be requested to provide your consent under the Fair Credit Reporting Act, which will authorize LendKey on behalf of the lender you are applying with to obtain information from your personal credit report and/or other information from the credit bureau, Experian (see contact information and website above).
